The 'problem' ultimately becomes, just who will actually enforce these new rules?
The EPA has already required for nearly a decade (If I remember correctly) that any remodeling contractor who does 'destructive' work on a home built before 1978 provide the owner with an EPA brochure indicating the potential dangers of lead paint.
To my knowledge, very few, if any, contractors have ever complied with this regulation.
I am one of those few, and have personally lost some remodeling jobs through the years because I really did as I was required... ---- As a current code enforcement official, I have been officially notified by our State's Department of Health of one case of lead poisoning of a child in one of the communities I serve.
The child's poisoning was the direct result of lead paint present in the home and the deteriorated condition of the rental property in which he and his parents lived.
While this does not directly concern me as a code official, nor do I have any jurisdiction in this matter...the presence of lead in homes built before 1978 remains an important concern for builders, designers, owners and renters of such properties...especially if pregnant women or children occupy them.
