Engineered wood floor installed on slab without vapor barrier. In addition, there is not enough gap expansion around perimeter. Won award; builder closed down and the Home Buyer's Warranty - insurance carrier just wants to pay to have the trim taken off, edges of planks trimmed,etc. I had 2 floor inspections; both of which found high humidity (22) in the subfloor and lack of vapor barrier, etc. I have been told that the floor needs to be done over. I would appreciated advise on how to handle this. Thank you.
As much as I hate to advise anyone to consult an attorney, I think that may be your only option at this point. It sounds like you've done your homework already; kudos to you, but now it's time to play hardball. It would be good to find someone familiar with both the construction industry and with contract law. Unfortunately, I have no idea how to find someone like that other than to start making phone calls.
I wish you the best of luck! It sounds like you have a good case, but the insurance company will stonewall you until they realize you are serious, and that means going to court, or at least the credible threat of doing so. Often a letter from a reputable law firm is enough, though.
Don't sign ANYTHING until you are represented and your attorney has given you advice that you understand and agree with.
