My Mom had a new shingle roof installed approx 5 years ago at her Cape Cod home. Now there is a leak on the roof around the fireplace. Apparently the flashing was not replaced around the fireplace when they installed the roof. Isn't that part of the reroof process and part of the code? They want her to pay to have the flashing installed. I think they should, because I think it was part of the reroof.

I'm not a roofer, but my opinion is that if he stated on his contract that he would supply new flashing, then he owes you that. I do not believe the average roofer would arbitrarily replace the flashing around a chimney, since it is embedded into the mortar of the chimney.

If he noticed the flashing was damaged, I think he should have brought it to your attention, but if it lasted 5 years from when he did the job, it would be hard to hold him accountable, unless he failed to do work called out on the contract.

Hi Pam,
I agree that the flashing should probably have been replaced. Just a note of advice, you may want to have a professional determine where the leak is coming from, as often times water around your fireplace can also result from problems with a chimney crown or chase cover. The flashing is important too, but have someone inspect the top of the chimney for signs of water penetration. This website explains what to look for. Hope this helps, and have a great day! -Tom
