OK - So now I received my permit. Although zoning dept. says non-conforming setback can remain. I didn't realize how technical the language on the permit would be. It says "nonconforming side setback allowed to remain." and "side setback must be at least 2.5' (eves not included) any further reduction of setback not permitted."

Since the fence is all crooked and big trees are in the way I really don't know the exact distance. Could be 18" to 3' who knows? I thought the whole idea is that garage has been there 12 or more years and no one ever complained so BFD.

The proposed work is 14' away on the other side of garage. Not changing the garage at all.

So now what do I do? I can do nothing and see what the guy says when he checks before pouring
house foundation that is at least 14' away.

I could cut about 2' off the back wall of garage to make absolutely sure it looks like at least 2.5' (major pita job but cheaper than a survey)

I could pay $2 to $5,000 for a full survey to find out what the setback really is. Then if its 18" what do I do?

Jay - ever had a problem like this? Why should it matter so much since NO work is proposed within 14' (width of existing garage) AND the neighbors never complained and no one is complaining now.

Obviously in hind site I should have got a full survey but I didn't. Should I just go for it and see if it gets questioned at foundation form inspection time?

Yes I've had problems like that, quite often unfortunately, and no don't just "go for it", it could mean a lot of problems. The only option here is a survey, it's the only way to know for sure. Make sure to be there when they survey and have them put a stake on the property line right by your garage so you can use it to measure. By the way, a survey shouldn't cost anywhere near what you are saying, should maybe be about $800 for a standard property survey. You can get it for less if you don't require a drawing from them.

I had a survey done for $900 about 5 years ago on a different place but the guy lied about recording it at county office. I should have complained to licensing board but I didn't know that at the time.
I guess I better get a good survey on this one like you say. "live and learn - it's only money rite!"
